Good Day!
I am sending this e-mail from Istanbul,Turkey as a seat mark auto customer.
My name is Guven Tepebas. I bought a brand-new car, Toledo 1.6 TDİ 105HP (Style Package) is worth of 45.889,66-TRY from KAYADIBI OTOMOTIV which it is sub-distributor of DOGUS OTO at 16.08.2013.
At the beginning of the february-14, unfortunately ı had a small accident , someone hit my car behind and because of this event ı took my car into authorized car service named DOGUS AUTO, Kartal branch in İstanbul. After overhaul, service clerk asked me that whether I bought that car cut-rate as defective good. Upon his that interesting question , surprisingly I asked him why he asked such question to me. He explained that there was a color difference on engine bonnet according to rest of the car. He went on and told me that mean of the engine bonnet was painted before, that why he asked such a kind question.
Whereupon I really get frustrated and once ı took my car another car service (car-expertise) to make new assessment. Service clerk again stated the same findings. They said to me that engine bonnet was painted.
It is clear that there was a hidden-defect in my brand-new car and this hidden defect was a kind of defect which could be determined only by technical equipments and experts. So it was not able to understand this hidden-defect with bare eyes.
This fault is a such kind of fault that it is highly reducing value of my car .
Even though it has been said to me that my car is brand-new car, as it seen on the enclosed expertise report and according to service explanation in words by DOGUS AUTO, this car was used car and there was paint on its some parts.
During the sale process of the car either ı was not informed that it was used or overhauled. This situation can be easily seen on the car sales document and sales agreement.
In accordance with the law no 4077 which is about “ Consumer Protection” and due to both of presence of the hidden-defect beforehand and selling of the defected car to me, all sides of this sale have joint liability.
With the all reasons explained above, ı claim to be changed my defected car with new one.
